Selvete Nura Update
The Aliens Appeals Board has decided to stay the removal order for Selvete
after a new submission by her lawyer, Eva Linda Sederholm and appeals from
a number of individuals and organisations including the Swedish Network of
Asylum and Refugee Support Groups (FARR). Selvete is no longer in custody
and is now staying with her brother.
The Aliens Appeals Board has two options.
It can decide that Selvete's case will be heard in Sweden. If so
her application will be sent back to the Immigration Board for proper
consideration and it is likely that she will be granted a temporary permit
of 11 months in accordance with the recent ordinance on temporary
protection for people expelled from Kosovo.
The second option is to uphold
the Immigration Board's decision to send her to Hungary. If this is done
then it should take place quite soon since the chances of Hungary accepting
her back are weaker the longer she is in Sweden.
As an applicant state to the European Union Hungary has had to impose
migration control instruments in advance that are in line with EU norms
even though these norms can only apply legally for full members. The
Secretary of State for migration, Gun-Britt Andersson, confirmed this at a
recent meeting in Linköping on May 9 and stated that within the European
Union the Dublin Convention regulates responsibility for determining asylum
claims but that it does not apply with regard to Hungary.
The Dublin
Conventions has clauses allowing a country to assume responsibility for an
asylum application even though it is not its formal responsibility
according to the basic principles of the convention. This can be done if
there are strong humanitarian grounds.
The chairman of FARR pointed out
that if Hungary is expected to implement the European Union's migration
principles in advance why can't Sweden apply the principles of the Dublin
Convention in advance in Selvete's case. The secretary of state responded:
